  1. General

Access to threesixtymarine.com (TSM) the “Website” are subject to the following terms, conditions and notices (the “Terms of Service”). By using the Website, you are agreeing to all of the Terms of Service, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms of Service. Access to the Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service without notice. We will not be liable if for any reason the Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of the Website. The Website may also contain links to other websites, which are not operated by TSM (the “Linked Sites”). TSM has no control over Linked Sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. Your use of the Linked Sites will be subject to the terms of use and service contained within each such site.

 

  1. Privacy Policy

We value your privacy. We won’t share or sell your email address.  Any information provided by you whilst accessing the Website is for the use of TSM and will not be made available to any third parties unless compelled to do so by a court, other competent body, or with agreement of our customers. By using the Website, you consent to the processing described and warrant that all data provided by you is accurate.

 

  1. Prohibitions

You must not misuse the Website. You will not commit or encourage a criminal offence; transmit or distribute a virus, trojan, worm, logic bomb or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person’s proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as “spam”; or attempt to affect the performance or functionality of any computer facilities of or accessed through the Website. Breaching this provision would constitute a criminal offence under the Computer Misuse Act 1990. TSM will report any such breach to the relevant law enforcement authorities and disclose your identity to them. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Website or to your downloading of any material posted on it, or on any website linked to it.

 

  1. Intellectual property, software and content.

You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on the Website nor may you use any such content in connection with any business or commercial enterprise.

 

  1. TSM community areas registration

TSM reserves the right to close accounts if any user is seen to be using proxy IPs (Internet Protocol addresses) in order to attempt to hide the use of multiple accounts or disrupt our Website in any way. If you use multiple logins for the purpose of disrupting the community you may have action taken against all of your accounts.

 

  1. Submission of material

By submitting any material to us either on the Website or Facebook, Twitter, Instagram, Pinterest and Linkedin, you automatically grant TSM the royalty-free, perpetual, exclusive right and license to use, reproduce, modify, edit, adapt, publish, translate, create derivative works from, distribute, perform and display such material (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed. In certain circumstances TSM may also share your contribution with trusted third parties. By submitting any material to us, you agree to use the TSM Community areas in accordance with these Terms and Conditions. If you fail to abide by these Community Rules you may be sent an email that informs you why your contribution has been refused or edited. This email will also include a warning that continuing to break the rules may result in action being taken against your account or accounts. This action may include temporary or permanent suspension of your ability to participate in any or all areas of TSM. TSM reserves the right to delete any contribution, or take action against any contribution, at any time, for any reason. If you do not want to grant TSM the permission set out above on these terms, please do not submit or share your contribution on the Community website / or TSM Facebook, Twitter, Instagram, Pinterest and Linkedin.

 

  1. Linking to the Website

You may link to pages on the Website, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you. The Website must not be framed on any other site, nor may you create a link to any part of the Website other than the Home page. We reserve the right to withdraw linking permission without notice.

 

  1. Indemnity

You agree to indemnify, defend and hold harmless TSM, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use the Website or your breach of the Terms of Service.

 

  1. Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

 

  1. Governing law and jurisdiction

These terms and conditions are to be construed in accordance with the laws of England and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the English courts.

 

  1. Entire agreement

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and TSM. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of TSM.
